These Terms of Service (“Terms”) govern access to and use of the theScoop platform, website, and related services (collectively, the “Service”), operated by theScoop (“theScoop,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
1. Who the Service Is For
theScoop is a business-to-business platform designed for restaurants and their authorized staff.
Restaurants create accounts to access feedback and insights
Guests may submit feedback without creating accounts
Guests do not receive ownership, access rights, or public profiles
You must be at least 18 years old to create a restaurant account.
2. Accounts & Access
Restaurant Accounts
To use the Service as a restaurant:
You must provide accurate and current account information
You are responsible for all activity under your account
You must safeguard login credentials
Access may be role-based (e.g., chef, manager, admin)
You agree not to share access with unauthorized users.
3. Guest Feedback & Anonymity
theScoop enables guests to submit anonymous, private feedback.
Guests are not required to provide identifying information
Feedback is visible only to the associated restaurant
Feedback is not published publicly by theScoop
Restaurants acknowledge that:
Feedback is subjective
theScoop does not verify the accuracy of guest submissions
Feedback is provided “as is” for internal insights only
4. Acceptable Use
You agree not to:
Attempt to identify or deanonymize guests
Use the Service to harass, discriminate, or retaliate
Reverse engineer, scrape, or interfere with the platform
Use the Service for unlawful or abusive purposes
Share or resell access without authorization
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Payments & Subscriptions
Billing
theScoop may offer paid subscriptions or features.
Payments are processed via third-party providers (e.g., Stripe)
Pricing, billing cycles, and features may change with notice
You authorize us to charge applicable fees
Cancellations
Subscription cancellations take effect at the end of the current billing period
Fees already paid are non-refundable unless required by law
6. Data & Ownership
Your Data
Restaurants retain rights to their own operational data
Guest feedback remains private to the restaurant
theScoop may aggregate and anonymize data for analytics and improvement
Our Platform
theScoop retains all rights to:
Software
Design
Trademarks
Algorithms
Platform functionality
You may not copy or reuse platform components without permission.
7. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect information.
By using the Service, you consent to those practices.
8. Availability & Changes
We aim to keep the Service available but do not guarantee uninterrupted access.
We may:
Modify features
Add or remove functionality
Suspend access for maintenance or security
theScoop is not liable for downtime or service interruptions.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, including:
Merchantability
Fitness for a particular purpose
Accuracy or reliability of feedback
Use of insights and feedback is at your own discretion.
10. Limitation of Liability
To the maximum extent permitted by law:
theScoop shall not be liable for:
Lost profits
Business interruption
Indirect or consequential damages
Decisions made based on guest feedback
Our total liability shall not exceed the amount paid to theScoop in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless theScoop from claims arising out of:
Misuse of the Service
Violation of these Terms
Actions taken based on feedback data

We may suspend or terminate access:
For violations of these Terms
For misuse or abuse
At our discretion with reasonable notice
Upon termination:
Access to the Service ends
Data may be retained per our Privacy Policy and legal obligations
13. Governing Law
These Terms are governed by the laws of the United States and the applicable laws of the state in which theScoop operates, without regard to conflict-of-law principles.

Continued use constitutes acceptance of the updated Terms
